New York law
protects the spouse with less money.

As part
of the "no-fault" divorce law recently enacted by New York, the legislature
also included provisions which protect the spouse with less money.
Frequently, one spouse (usually
the wife) is being supported by the other. In the past, this
meant that the "moneyed" spouse held all the cards because he
was the one who could afford a lawyer. The less moneyed spouse
was held hostage for fear that she could not get representation.
Moreover, there existed the threat that she would be cut off
from the money she needed to support herself.
The new law changes all this.
There is now a presumption that
the moneyed spouse will pay the legal fees of the non-moneyed
spouse. In addition, the moneyed spouse is expected to pay
spousal support (alimony) to the non-moneyed spouse for her
maintenance during (and after) the divorce litigation.
The bottom line is... don't be
afraid to file against your spouse due to your economic
disadvantage. The playing field is now leveled. We may be able
