Q. How does the process work?
A.
First, we'll ask you to fill out the form
located
here. Then, based on your answers, we
will send an invoice to your email address so you can make your down
payment online by credit card OR we'll set up an appointment for you to
come in and make payment. After your payment is
received, we
will prepare and file the summons & complaint and
have your spouse served by the method you choose (in-person, email, or
mail).
After your spouse signs his or her papers,
you will need to sign the final papers for filing with the court. We can
handle this by mail or email.
After that, it's just a matter of waiting for the court
to issue the judgment.
Q. How long will my New York uncontested divorce take?
A. The faster your spouse signs &
returns the necessary paperwork, the faster your divorce can be
finalized. Be aware that due to recent court cutbacks, layoffs, and
judicial retirements, your case can take about 3-5 months to
complete. We complete and process your paperwork very quickly. The
majority of the waiting time is due to court backlog.
Q. What if my spouse refuses to sign the papers?
A. You can still get your New York uncontested divorce without your spouse's cooperation,
but we will have to serve him/her personally (possible extra charge) and wait at least 40 days from the date he/she
was served to proceed with the final steps.
Q. Will I need to go to court?
A. If your divorce remains uncontested, you will not have to go to
court at all. In fact, you do not even need to come in to our
office. Ever. We can handle the entire process by mail, phone,
email, etc. The only exception is in the rare event that the court
orders an inquest, which may be required if there has been any
history of domestic violence and/or orders of protection. Q.
Do you offer payment plans?
A. Yes, but it will cost you a little more. A 50% down payment would
be due in order to get your case started. The balance would need to
be paid before we file the Note of Issue (the last step to complete
the divorce). Q. What happens if an uncontested divorce becomes
contested?
A. This is always a possibility. After your spouse is served with
the divorce papers, he or she can decide to contest the divorce,
meaning that they do not agree with the specified grounds, the
relief sought, demands for support, or the terms of property
division or child custody arrangements. If this happens, then your
uncontested divorce becomes contested and it will cost you (and your
spouse) significantly more legal fees (and time, including court
appearances). However, our hourly fees are about half the
price of most other NY attorneys.
Q. I don't know where my spouse lives. Can I
still get a divorce?
A. No problem. You can still get a New York
uncontested divorce. However, due to the extra filings and procedures
involved, there are substantial extra costs, including motion
preparation and filing, affidavits by a process server, and
court-ordered advertising. Your total will likely be $3000 to $3500. While this
may seem like a high cost, it is considerably less than most other
attorneys, who often quote more than $4000 for the same thing.
Q. What is the advantage of third-party personal service?
A. If you have your spouse personally served by our
process server, then we have proof that he/she received notice of the
divorce. This will allow us to finalize your divorce even if your
spouse refuses or forgets to sign & return the papers. You'll save
money without personal service, but your case will expire if your spouse
delays long enough. Therefore, we suggest that you choose personal
service unless you are absolutely sure that your spouse will sign
& return the papers to us.

A. Yes. Since all documents and communications are
handled via phone & email, we can help you no matter where you are in

A separation agreement is a legal
contract between spouses that addresses the division of assets and
liabilities, as well as any support, maintenance, custody or visitation
issues. The agreement may be filed with the County Clerk and is
enforceable by the courts. At the end of one year from the date of
the agreement, either spouse may file for divorce based on the one-year
separation. The separation agreement may be included in any future
divorce judgment. Most divorce lawyers charge $1,500 and up for
separation agreements in New York.
